If you lose your job in Japan and your employer was enrolling you in employment insurance (雇用保険, koyou hoken), you can claim unemployment benefits (基本手当, kihon teate) at Hello Work — regardless of your nationality. There is no special foreign-worker exclusion.
The two conditions that qualify you:
- Working ≥ 20 scheduled hours per week at the time you were enrolled
- Expected to be employed for ≥ 31 consecutive days when you were hired
If both were true when you started, your employer was legally required to enroll you. Benefits then depend on how long you were insured and why you left.
The critical caveat for work-visa holders: Collecting unemployment benefits does not, by itself, put your visa at risk. But being unemployed for 3+ months without actively job-seeking can trigger visa cancellation under the Immigration Act — independent of whether you are receiving benefits. You must actively job-search while collecting, and maintain records.
Who Is Covered — and Who Is Not
Covered under standard conditions (≥ 20 hrs/week, ≥ 31-day expectation)
- 技術・人文知識・国際業務 (Engineer / Humanities / International Services)
- 特定技能 1号・2号 (Specified Skilled Worker)
- 定住者 (Long-Term Resident)
- 永住者 (Permanent Resident)
- 日本人配偶者等 (Spouse of Japanese National)
- 家族滞在 (Family Stay) — only if you have a 資格外活動許可 (work permit) and the 20-hr/week condition is met

How Long You Must Have Been Insured to Claim
Voluntary resignation (自己都合退職)
You must have been insured for at least 12 months within the 2 years before your separation date.
Involuntary separation (会社都合・特定受給資格者)
This includes: company dismissal, bankruptcy, contract non-renewal (yatoidome 雇止), forced resignation, or substantial working condition changes that caused you to leave. In these cases you need only 6 months of insured period within the 1 year before separation.
If you believe your separation was involuntary even though paperwork says otherwise, you can challenge the classification at Hello Work. The distinction matters significantly for both the waiting period and the benefit duration.
Waiting Periods and Benefit Restrictions
7-day waiting period (待期期間) — applies to everyone
No benefits are paid for the first 7 days from the date you apply at Hello Work. This applies universally.
Voluntary resignation — 1-month restriction (給付制限)
From April 1, 2025, the additional restriction period for voluntary resignations was shortened from 2 months to 1 month in most cases.
Exception — the restriction is 3 months if:
- You voluntarily resigned twice within the past 5 years, or
- You were dismissed for serious misconduct (重責解雇, treated as self-caused separation)
Vocational training exception: If you started or completed a government-approved vocational training program within 1 year before or after separation, you receive benefits immediately after the 7-day waiting period with no restriction.

Company-initiated separation — no additional restriction
7-day waiting period only. Benefits begin the 8th day.
How Much You Receive
Daily benefit formula
Step 1 — 賃金日額 (your daily wage rate):
(Total gross wages in the 6 months before separation, excluding bonuses) ÷ 180
Step 2 — 基本手当日額 (your actual daily benefit):
賃金日額 × benefit rate (50%–80% depending on wage level)
Lower-wage workers receive up to 80% of their daily wage. Higher-wage workers receive approximately 50%. The sliding scale is published annually by MHLW.

The maximum of 330 days applies to workers aged 45–59 with 20+ years of insured history who were involuntarily separated.
The Hello Work Process — Step by Step
What you need to bring
- 離職票 (Rishokuhyo) — Certificate of Separation, issued by your employer within 10 days of your last day. Takes 2–3 weeks to arrive. Without this, you cannot apply.
- 雇用保険被保険者証 (Employment Insurance Card) — held by your employer; ask them to return it when you leave
- Zairyu Card 在留 (Residence Card)
- My Number Card or notification slip (My Number required)
- Bank passbook or cash card (for direct deposit of benefits)
- Two recent photos (approx. 3cm × 2.5cm) — may be waived if you have a My Number card
- 印鑑 (personal seal, or signature)

The process
- Receive 離職票 from employer — typically within 2–3 weeks after last day
- Visit Hello Work — bring all documents above; register as a job-seeker (求職者登録) and file your unemployment application
- Attend mandatory orientation (受給説明会) — scheduled by Hello Work, usually within 2 weeks of application
- Complete 7-day waiting period (待期期間) — no benefits during this time
- For voluntary resignation: observe the 1-month restriction (unless exceptions apply)
- Certification days (失業認定日) — visit Hello Work every 4 weeks on your assigned date; you must report at least 2 job-seeking activities per 4-week period (applications, interviews, career counseling, etc.)
- Benefits deposited — typically within 5 business days of each certification day
Visa Implications: The 3-Month Rule
This is the most important section for foreign workers on employer-tied visas.
You must notify Immigration within 14 days of job loss
Under the Immigration Act, any work-visa holder must file a keiyaku kikan todokede 契約機関届出 (notification of change to affiliated organization) with the Immigration Services Agency (ISA) within 14 days of losing their job. You can file online via the ISA portal. Failure to notify can affect future visa applications.
The 3-month inactivity risk
For holders of employer-tied visas (技術・人文知識・国際業務, 特定技能, 介護, 技能 and similar):
If you are unemployed for 3+ months without a legitimate reason for not job-seeking, your residence status can be cancelled under the Immigration Act.
What counts as legitimate activity:
- Registered at Hello Work and attending certification days ✅
- Submitting job applications and attending interviews ✅
- Completing vocational training ✅
- Medical treatment preventing work ✅
Collecting benefits alone — without documented job-seeking — is not sufficient to protect your visa.
Practical action: Keep written records of every job application, interview, and Hello Work visit. If immigration asks about your period of unemployment, these records demonstrate legitimate activity.

Changing status to 特定活動 (job-seeking)
If your work visa is expiring while you are still unemployed, you may be able to apply for a 特定活動 (job-seeking designated activity) status change — a visa type specifically for foreigners who lost their job and are actively seeking new employment. This is discretionary; you must demonstrate active job-seeking with documentation. Consult an immigration attorney or 行政書士 if you are approaching your visa expiry date.
定住者 and 永住者 — far less risk
Long-Term Resident and Permanent Resident statuses are not employer-tied. You can work in any field and your status remains valid regardless of employment gaps. There is no 3-month activity requirement tied to these visa types. You can collect the full benefit duration without visa cancellation concern.
Can You Collect If You Leave Japan?
No. 基本手当 requires you to be in Japan and able to work. Every 4 weeks, you must physically attend the Hello Work certification appointment in person. If you are abroad:
- Your certification day passes without attendance
- Benefits for that period are suspended
- If you fail to report travel in advance, it may be treated as a benefit violation requiring repayment
If you plan to travel temporarily while receiving benefits, notify Hello Work before you leave and understand that benefits will not be paid for the period of absence. Upon return, you can resume certification.
If you return permanently to your home country, benefits cease. Unlike the national pension (which has a 脱退一時金 lump-sum refund for non-permanent residents), there is no equivalent lump-sum refund for employment insurance contributions.
Premium Rates (as of April 2025)
Employment insurance premiums are split between you and your employer:

FAQ
Q1. My company never told me I was enrolled in employment insurance. How do I check? Check your pay slips (給与明細) — employment insurance premiums (雇用保険料) should be listed as a deduction. If they were deducted, you were enrolled. If you were not enrolled despite being eligible, your employer violated the law. Contact Hello Work with your pay slips; they can retroactively enroll you and assess the employer for back premiums.
Q2. I resigned voluntarily because my working conditions were unbearable (harassment, unpaid wages, forced overtime). Do I still face the 1-month restriction? Possibly not. If your resignation meets the criteria for "constructive dismissal" (特定理由離職者) — which includes severe working condition violations, harassment, unpaid wages, significant commute changes — Hello Work may reclassify your separation as involuntary, eliminating the restriction period and reducing the insured-period requirement to 6 months. Document everything and clearly explain the circumstances when you apply.
Q3. I'm on 特定技能 and just lost my job. What should I do in the first week? Three things within the first two weeks: (1) Notify ISA of your job loss online within 14 days; (2) Contact your Specified Skilled Worker support organization (登録支援機関) if you have one — they are legally required to help you with your job search; (3) Request your 離職票 from your former employer immediately so you can apply at Hello Work as soon as it arrives.
Q4. My contract ended and was not renewed. Is that voluntary or involuntary? If your fixed-term contract ended without renewal and you did not decline renewal yourself, this is typically classified as yatoidome 雇止 (dismissal by non-renewal) — an involuntary separation. This means: 6-month insured period requirement, no additional 給付制限, and longer benefit duration based on your age. Confirm the classification when you apply at Hello Work.
Q5. Can I start my own business or freelance while receiving unemployment benefits? Generally, no — 基本手当 is designed for people seeking paid employment. If you start a business or regularly work as a freelancer while collecting, you must report this to Hello Work; benefits may be suspended or reduced. However, occasional minor income (arubaito) under the weekly hour threshold may be permitted if reported — check with Hello Work. Note that starting a business would also typically require a change in your visa status.
